According to CNBC, which cites informed sources, the White House has completed the review of candidates for the four vacant commissioner positions at the Commodity Futures Trading Commission (CFTC). However, there is still no clear indication as to when nominations will be made, or even whether any will be submitted at all. This personnel issue is intertwined with the progress of the Senate's deliberation on the Crypto Markets Structure Act, known as Clarity Act.

CFTC Currently, only Chairman Michael Selig remains as a member in office. By convention, this body should consist of 5 members, including seats for the ruling party and the opposition parties. As the main regulatory agency for the U.S. derivatives market, the long-term vacancy in the personnel of CFTC has drawn continuous attention from both parties.

Only one committee member is currently in office.

CFTC It is legally required to consist of 5 members, usually 3 from the party affiliated with the White House and 2 from the opposition parties. However, as of now, the remaining 4 seats are still vacant.

Earlier this year, Bloomberg reported on potential bipartisan candidates being considered by the White House. At the beginning of July, the Trump administration wrote to Senate leaders, stating that the Democratic side had not yet submitted a list of recommendations for the vacant positions at the CFTC and the U.S. Securities and Exchange Commission (SEC), hence the personnel appointments at these two Wall Street regulatory agencies have not progressed yet.

However, the office of Senate Minority Leader Schumer stated that they submitted recommendations for the CFTC and SEC Democratic seats to the White House at the end of July, and expressed support for maintaining a "complete and cross-party" committee structure. The office also mentioned that they have not received any further feedback from the White House to date.

Personnel vacancies affect the voting on the encryption bill

The report indicates that the issue of vacant seats for CFTC has become a point of contention in the negotiations of Clarity Act. Clarity Act is a bill concerning the structure of the crypto market, and for the Senate to advance its passage, it needs to gain the support of Democratic senators.

Some Democrats have criticized that the White House has been slow to fill the seats reserved for Democrats at SEC, as well as the 4 cross-party vacant seats at CFTC, which has weakened the proper functioning of regulatory agencies and also affected the atmosphere of bill negotiations.

A person familiar with the review process and a Republican involved in advancing the bill said that if the White House explicitly commits to filling the vacancy of CFTC, it could become a concession to help the bill pass. However, this is not the only obstacle facing the bill; ethical issues surrounding the interests of the Trump family's crypto business are also slowing down the legislative process.

A key procedural vote will take place on September 15th.

The Senate is expected to conduct a key procedural vote on Clarity Act on September 15th. Republicans involved in advancing the bill stated that if the bill does not pass the Senate, they anticipate that the White House will not proceed with the nominations for the remaining 4 seats of CFTC.

The call to fill the CFTC committee seat as soon as possible does not come from a single party. The chairman of the U.S. House Agriculture Committee, Glenn Thompson, and the Democratic leader of that committee, Angie Craig, had already called on Trump to nominate the relevant members back in May. Craig stated again this week that the Trump administration should ensure that CFTC has the personnel and resources necessary to fulfill its regulatory responsibilities.

Thompson also stated that he has not received any feedback from the White House regarding potential nominations at this time, but he believes that qualified candidates should be submitted to the Senate for confirmation as soon as possible.
