As more than twelve states have enacted specific legislation for companion chatbots, the lack of a unified federal framework has led to increasing compliance costs. California was the first to establish a comprehensive model, prescribing a fine of $1,000 for each violation. Other states such as Oregon, New York, and New Hampshire have also implemented their own regulations, resulting in complex and overlapping requirements. Despite these geographical differences in laws, there is a consensus on core requirements, which include clear disclosures that indicate the robots are not human, specific measures to protect minors, and robust protocols for detecting suicidal tendencies. The main risk faced by developers is the significant differences in enforcement mechanisms. In states like California and Oregon, the threat of class actions persists due to private prosecution rights, whereas Georgia has chosen to have enforcement carried out by the state attorney general, with fines of up to $10,000. At the federal level, regulatory progress remains stagnant; although the Federal Trade Commission has issued a research order, it is still in the information collection phase.
