According to CoinMeta, Polymarket has announced that it will file a lawsuit against the gambling ban in the Netherlands and plans to re-ignite the controversy on October 5th, after previously being fined 420,000 euros for violating the ban. Dutch media NL Times reported that Polymarket intends to challenge the decision of the Dutch Gambling Authority (KSA) to classify its platform as an unlicensed gambling service. Polymarket argues that users are trading financial contracts related to future events, and therefore regulation should fall under the jurisdiction of the Dutch Financial Markets Authority (AFM). This controversy is not new; Adventure One QSS Inc, the KSA-designated Polymarket operating company, has already challenged the regulatory authorities through the Dutch administrative appeal process. In June, KSA rejected this appeal and upheld the original enforcement order. Polymarket's argument focuses on how its predictive contracts function, where users buy and sell positions related to future events, and the winning shares are paid out based on the final outcome. Polymarket believes that its services are not similar to traditional gambling companies, as transactions occur between users, and prices are determined by market demand, rather than the odds set by gambling companies.
