Arizona court overturns verdict based on videos of victims generated using AI

According to CoinMeta, the Arizona Court of Appeals overturned the 10.5-year prison sentence imposed on Gabriel Jocaxitas for a road rage incident in 2021, on the grounds that the judge who rendered the verdict should not have considered a video of the victim, Christopher Pelleky, which was generated using AI. Although the conviction remains in effect, the case will be sent back for a retrial. Three judges stated that the video generated using AI improperly influenced the sentencing process, leading to procedural injustice. The court deemed that the impact of this video on Jocaxitas was sufficient to render the sentencing procedure fundamentally unfair. Pelleky’s family created this video using short video clips, funeral images, and various AI tools; in the video, the person introducing themselves during the conversation with Jocaxitas claimed to be the creator using AI. This ruling comes amid challenges faced by courts regarding artificial evidence. Over 80% of U.S. court cases rely in part on video evidence, yet there are currently no unified rules for dealing with videos generated or enhanced using AI.
