The staff stated that these contracts should be considered vulnerable to manipulation. The recommendation mentions that the settlement of these contracts relies on the behavior of a particular individual and may not be independently generated or externally verifiable. The CFTC's recommendation does not have legal binding force and merely represents the views of the staff. It was issued after the CFTC reached a settlement with former White House speechwriter Gabriel Perez last month, who was fined $172,000 for trading on contracts related to presidential mentions.
