Oracle has issued a force majeure notice to the developers regarding the Project Jupiter data center campus in New Mexico. According to Bloomberg, which cited informed sources, this move is not intended as a withdrawal from the project, but rather to reserve contractual flexibility in case the campus cannot be commissioned on time by the 2028 target date, allowing for delayed payments.
Notification does not equal exiting the project.
Force majeure clauses are commonly found in energy and commodity contracts to address events beyond the control of the contracting parties. According to informed sources, Oracle remains the main tenant of the park, and the purpose of issuing the notice is not to terminate the cooperation, but to provide a buffer for potential delays.
Oracle indicates that Project Jupiter is still progressing according to the original plan, and the company is "fully committed to the New Mexico project." The units under Blue Owl Capital that received the notification also stated that this notice will not change the financial commitments for this multi-year project.
Natural gas and licensing still need to be advanced.
The designed capacity of Project Jupiter is 2.45 gigawatts, and it is planned to use the gas fuel cell system of Bloom Energy for power supply. Therefore, a stable supply of natural gas becomes an important prerequisite for the park to be launched on schedule.
A Energy Transfer pipeline that was originally intended to transport natural gas to the industrial park has been postponed for nearly 6 months, with the new deadline set for February 1, 2027. Regulators had previously rejected the pipeline licensing application several times, and Bloomberg previously reported that the pipeline route had been adjusted in August.
- The designed capacity of the park is 2.45 gigawatts.
- Natural gas pipeline construction postponed to February 1, 2027
- The targeted commissioning time for the park is 2028.
Apart from the pipelines, the air quality permits required for the fuel cell systems in the park are still under review. The New Mexico Department of Environment needs to make a decision by November 23rd.
Stargate The project faces local resistance
Project Jupiter is one of the iconic parks in the Stargate initiative. This plan was jointly announced by Oracle, OpenAI, and SoftBank at the beginning of Trump's second term, and is positioned as a major infrastructure construction project in the United States.
However, this industrial park has encountered opposition from some residents and environmental groups, and has become a point of local political contention before the mid-term elections. Bloomberg reports that Oracle has launched public communication efforts in the area in an attempt to gain more support.
