According to CoinMeta, multiple stakeholders submitted court briefs to the U.S. Supreme Court last week, calling on it to review cases regarding whether contracts in the sports betting market constitute swaps. Former Senator Chris Dodd, former Commodity Futures Trading Commission Chair Gary Gensler, the National Football League, 39 states, and 145 tribal nations, among others, are involved in this effort, arguing that products in the sports betting market should not be considered swaps and therefore should not be subject to CFTC regulation. On Friday, CFTC issued two proposals aimed at clarifying how these products fall under the definition of a “swap.” The agency stated that casino-style gambling does not fall within the definition of a swap, but event-based contracts are still within its scope of regulation.
