The timeline for advancing legislation on the structure of the cryptocurrency market in the U.S. Senate is tightening. Senate Majority Leader John Thune stated that the much-anticipated "Clarity of Digital Asset Markets Act" is unlikely to be passed before the long summer recess, but he still hopes to bring the bill to the Senate floor first.

The window of opportunity may not open in early August.

Industry insiders and congressional negotiators had previously considered August 7th a critical juncture. If the bill fails to make significant progress by this date, the chances of completing legislation by 2026 will significantly decrease.

Thune told reporters that he hoped to initiate the relevant procedures before the recess and observe the vote count in the Senate. If this step could be taken before the recess, the bill could still move forward during the brief congressional reconvening in September.

Recess and election time compression

After its summer recess, the U.S. Congress will focus more on the midterm elections. The House and Senate are expected to briefly return to Washington in September, but time available for votes will be limited, and multiple agenda items will compete for scheduling.

The report mentions that Thune's team is currently prioritizing another bipartisan bill: one that imposes sanctions on the Russian leadership and tariffs on related trading partners. This bill, originally pushed by Senator Lindsey Graham who passed away earlier this month, is expected to be scheduled for the Senate as early as next week.

The differences between the two parties have not yet been resolved.

The crypto bill has sparked controversy within both parties after its final working draft was completed this week. Some Democratic lawmakers oppose the bill's restrictions on the crypto business activities of senior government officials, with particular attention focused on provisions related to President Trump.

Besides Democrats, some Republican senators also raised reservations about the bill's contents, focusing on how stablecoin yields would be handled and the wording of the government ethics clauses. According to Senate procedures, bills typically go through multiple stages and usually require a 60-vote threshold to pass; therefore, even the majority support needed for passage cannot be considered certain at this point.

Republican Senator Cynthia Loomis, who participated in the negotiations, previously stated that the most controversial parts could still be revised, which she believed might leave room for gaining some Democratic support.

If the bill is delayed until later this year, its chances of passing in 2026 will further decrease. The market had previously expected the Senate to make broader progress in the coming weeks, but current statements suggest the window of opportunity is narrowing.
