Farzam Ehsani: South Africa's cross-border crypto asset draft will hit the local industry and lead to capital outflows

According to CoinMeta, Farzam Ehsani warns that if the draft regulations on cross-border crypto assets issued by South Africa's Ministry of Finance and the Reserve Bank of South Africa are implemented as currently proposed, it will harm the local crypto industry, innovation, and investment, and drive funds and trading volumes offshore and into the underground market. The draft allows individuals to transfer crypto assets within their existing foreign exchange limits, but prohibits enterprises from conducting cross-border crypto transactions, and considers various types of deposits from self-hosted wallets as "unlicensed" capital flows for locally licensed platforms. Ehsani points out that this will force businesses and users to turn to unregulated platforms overseas, weakening regulatory oversight and the tax base. They call for the abolition of capital controls that have been in place for decades or for the rewriting of these rules based on the principle of technical neutrality, while still maintaining necessary reporting and transparency.
