In May, Spain prohibited Polymarket and Kalshi due to their lack of a Spanish license, while Germany does not have a license application process available. The challenge faced by German regulators is that the cryptographic infrastructure of prediction markets has changed the way regulation is implemented. Under the 2021 Gambling States Treaty signed by all 16 states in Germany, betting on non-sports events such as political elections, court rulings, and natural disasters is simply not permitted.
